Terms of Service

These Terms of Service ("Terms") govern your use of chattybot.ai and any services provided by LS Growth Solutions, LLC ("ChattyBot," "we," "us," or "our"). By using our website or engaging our services, you agree to these Terms.

1. Services

ChattyBot.ai is a brand operated by LS Growth Solutions, LLC. We provide AI-powered business automation services including AI voice agents, chat agents, automated follow-up systems, and CRM setup and configuration. Specific deliverables, pricing, and timelines are defined in your service agreement or invoice.

2. Eligibility

You must be at least 18 years old and have legal authority to enter contracts on behalf of any business you represent. By using our services, you confirm you meet these requirements.

3. Payment Terms

Monthly fees are billed in advance and automatically charged on your billing date
Setup fees are billed at project start and are non-refundable once work begins
Usage fees (calls, SMS, AI interactions) are billed separately at cost through your usage account — no markup
Late payments may result in service suspension until current
All fees are in U.S. dollars

4. Cancellation

Service is month-to-month after setup. You may cancel anytime with 30 days written notice to LSGROWTHLLC@gmail.com. Setup fees and any work completed are non-refundable. Usage account fees continue until you close your usage account directly with the provider.

5. Client Responsibilities

You agree to:

Provide accurate information needed to deliver services
Maintain your own accounts (Google, Facebook, etc.) and grant necessary access
Pay all fees on time
Use our services only for lawful business purposes
Comply with all applicable laws including TCPA, CAN-SPAM, and consumer protection regulations regarding outbound messaging

6. Intellectual Property

Our property: All proprietary methodologies, templates, automation frameworks, and documentation we develop remain our property.
Your property: Your business data, customer lists, brand assets, and content remain yours. You own the CRM data we manage on your behalf.
License: During the term of service, we grant you a non-exclusive license to use the configured systems we build for you.

7. Service Availability

We strive for high uptime but do not guarantee uninterrupted service. Many components rely on third-party providers (Go High Level, Twilio, OpenAI, etc.) whose availability is outside our control. We are not liable for downtime caused by third-party outages.

8. Results & Disclaimers

We use proven systems and best practices, but we make no guarantees about specific business results, lead volume, conversion rates, or revenue. Results depend on factors including your market, offer, traffic, and execution. Examples and case studies reflect actual results but are not promises of future performance.

9. Limitation of Liability

To the maximum extent permitted by law:

Our total liability for any claim is limited to the amount you paid us in the three months preceding the claim
We are not liable for indirect, incidental, consequential, or punitive damages including lost profits, lost business, or lost data
These limitations apply even if we have been advised of the possibility of such damages

10. Indemnification

You agree to indemnify and hold harmless LS Growth Solutions, LLC, its members, and contractors from any claims, damages, or expenses arising from your use of our services, your violation of these Terms, or your violation of any third-party rights or laws.

11. Confidentiality

Both parties agree to keep confidential any non-public business information shared during the engagement. This obligation survives termination of services.

12. Modifications

We may update these Terms occasionally. Material changes will be posted on this page with an updated Effective Date. Continued use of our services after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in El Paso County, Colorado.
